Giving birth to a child is more than just a miracle. It can bring along some legal matters, especially when the parents aren’t married.
“Unwed mothers have custody of their children when they’re born.”
Practicing family law for the last 20 years, Courtney Hannah says the law treats unmarried fathers differently than ones who are married. Even if their name is on their biological child’s birth certificate, state law requires them to go to court to get legal custody.
“I recommend for my unwed fathers to immediately seek the court intervention in the beginning, even if the parties are still together, even if they’re dating.”
Hannah says when the parents are in agreement, the path of receiving paternity rights is easier. But when that doesn’t happen, the process isn’t as streamlined.
