The impact of a civil protection order on child custody may depend on whether the triggering incidents took place around the child or involved the child. If the dispute that triggered the CPO did not in any way involve the child, the Court may feel it has little or no bearing on the child custody issues as both parents seem to be fine around the children, maybe just not each other.
If the incidents that triggered the CPO did involve the child in some way, it could have a severe impact on the custody determination. If there is a CPO in effect and the parties are not able to communicate at all, not able to text, not able to speak, and/or not able to email, then it will likely be harder to implement a shared parenting plan when the parties are not able to communicate minimally.
