We always recommend that we look through the title commitment and make sure it meets all of the requirements and that all of the exceptions are covered before the buyer’s inspection is scheduled.
From an insurance standpoint, title insurance is to reduce liability. They are going to put in as many exceptions as they can, and if you don’t have a skilled attorney looking at that, you are going to have exceptions in your policy that shouldn’t be there.
In almost every one of our closings, we get the title company to release some of the standard exceptions from the policy. Often people will close without a lawyer, and they often are unaware of what is in their title insurance policy, and this is important because the policy lasts as long as the property is owned by the insured.
