Let’s say we’re representing the wife in a divorce proceeding: The husband has left the house, and in the divorce decree it says he is to receive all the items from Exhibit A, by a certain date. If he doesn’t remove those items by that date, we would send his lawyer notification that he has failed to do it, writing something to the effect of, “Please have him remove his items within 30 days.”
If he still has not removed his belongings within 30 days, then the following will occur:
- We will move those items ourselves into a storage facility.
- We will inform him of the location of the storage facility where he can collect his belongings.
- We will let him know that we will seek money from him to reimburse us for the monthly storage fee; and reimburse us for removing items from the home to the storage facility.
